An account may be required to make certain purchases.

5. PRODUCT INFORMATION
The Seller undertakes to ensure that the descriptions, photographs, colors, sizes, measurements and other information relating to the Products displayed on the Site are as accurate and up to date as reasonably possible.
Product images are provided for illustrative purposes. Some images may have been created or edited, including through the use of artificial intelligence (AI) tools, based on original photographs of the Products. Such editing is solely intended for presentation purposes and does not alter the characteristics, composition or nature of the Products actually sold.
Minor differences in the visual rendering of colors or in the appearance of images, including those resulting from the settings of the screen used by the Customer, shall not in themselves constitute a lack of conformity of the Product, without prejudice to applicable law.
The Seller reserves the right to update information relating to Products, their availability and their characteristics at any time, without such changes affecting orders already confirmed.
6. ORDERS AND CONCLUSION OF THE CONTRACT
The Customer may place an order by following the purchasing procedure available on the Site.
Before submitting an order, the Customer will be shown the main characteristics of the Products, their prices, any shipping costs, available payment methods and any other information required by applicable law.
Submission of an order by the Customer constitutes a binding contractual offer by the Customer.
Upon receipt of the order, the Seller will send the Customer an order confirmation to the email address provided during the purchasing process.
The sales contract shall be deemed concluded when the Customer receives the order confirmation, except where the Seller is required or entitled not to proceed with the order pursuant to these Terms and Conditions or applicable law.
The Seller reserves the right not to accept or to cancel an order, promptly notifying the Customer, in cases including Product unavailability, failure to obtain payment authorization, an obvious error in the price or Product information, suspected fraud, unlawful use of the Site or other circumstances provided for by law.
If a confirmed order cannot be fulfilled due to unexpected Product unavailability or a material error, the Seller shall inform the Customer and, where applicable, refund any amounts already paid.
If only part of an order cannot be fulfilled, the Seller may contact the Customer to agree on the shipment of the available Products and the refund of any unavailable Products.
7. PRICES AND PAYMENTS
All Product prices displayed on the Site are expressed in the currency shown at checkout and include VAT, where applicable.
Any shipping costs or other applicable charges will be clearly indicated before the order is submitted.
The Seller reserves the right to change Product prices at any time. Price changes shall not apply to orders that have already been confirmed.
The Customer may pay for the order using the payment methods available at checkout. Available payment methods may vary depending on the Customer's country or location and other factors relating to the purchase.
Payments are processed securely through Shopify Payments and, where applicable, through the payment methods or services made available through Shopify Payments.
The payment methods available for each order will be displayed at checkout before the purchase is completed.
The Seller does not directly access or store full payment card details. Payment information is securely handled by the relevant payment service providers in accordance with their respective terms and conditions and privacy policies.
If payment authorization is declined, cancelled or cannot be completed, the Seller may refrain from processing or shipping the order until payment has been successfully completed.
The Seller shall not be liable for any delays or failure to process an order resulting from the rejection, cancellation or failure to complete payment authorization by the relevant payment service provider.
8. INVOICING
If the Customer wishes to receive an invoice, they must provide all necessary and accurate information through the procedures available on the Site or as otherwise indicated by the Seller.
The Customer is responsible for the accuracy and completeness of the billing information provided.
The Seller shall not be liable for any invoicing errors resulting from incorrect, incomplete or outdated information provided by the Customer.
9. SHIPPING AND DELIVERY
Orders are processed and shipped to the address provided by the Customer at the time of purchase.
Available shipping methods and estimated delivery times are indicated at checkout and may vary depending on the destination country, Product availability and the selected shipping method.
Unless otherwise agreed with the Customer, the Seller shall deliver the Products within the period required by applicable law.
Delivery times indicated on the Site are estimates and may be affected by circumstances beyond the Seller's direct control, such as carrier delays, weather conditions, customs checks or other circumstances that could not reasonably have been foreseen or controlled by the Seller.
For shipments to countries outside the European Union (non-EU countries), any customs duties, taxes, import charges or other costs imposed by the authorities of the destination country shall be borne by the Customer and are not included in the Product price or, unless otherwise stated, in the shipping costs.
Such amounts may vary depending on the destination country and local regulations and may be charged directly to the Customer by the relevant authorities or carrier.
The Customer is responsible for checking any applicable costs, taxes or customs requirements in their country before placing an order.
The Customer is responsible for ensuring that the shipping address provided is accurate and complete.
If the Customer has provided an incorrect or incomplete address, they should contact Customer Service as soon as possible. The Seller will make reasonable efforts to correct the address before shipment, but cannot guarantee that the change can be made in time.
Upon delivery, the Customer is advised to check the condition of the packaging and the Products received and to notify Customer Service of any visible damage or discrepancies as soon as reasonably possible.
All statutory rights relating to defective, damaged or non-conforming Products remain unaffected.
10. RIGHT OF WITHDRAWAL
If the Customer is a Consumer, they have the right to withdraw from the purchase contract within 14 days from the date on which the Consumer, or a third party designated by the Consumer other than the carrier, acquires physical possession of the Products, without having to provide any reason.
To exercise the right of withdrawal, the Consumer must notify the Seller of their decision to withdraw within the period prescribed by law, by means of an explicit statement or by using the withdrawal form available on the Site. Use of the form is not mandatory.
The withdrawal notice may be submitted through the contact methods indicated on the Site.
Once withdrawal has been communicated, the Consumer must return the Products without undue delay and, in any event, within 14 days from the date on which the withdrawal was communicated.
Products must be returned in a condition that allows the Seller to verify their nature, characteristics and functioning.
The Consumer shall be liable for any diminished value of the Products resulting from handling other than what is necessary to establish their nature, characteristics and functioning.
The Seller recommends returning Products unused, unwashed and complete with their original tags, labels and accessories, where applicable.
All Products returned under the right of withdrawal will be inspected. If a diminished value is found to have resulted from use or handling beyond what is necessary to establish the nature, characteristics and functioning of the Product, the Seller may apply the provisions of applicable law concerning such diminished value.
The direct costs of returning Products in the event of withdrawal shall be borne by the Consumer, unless otherwise stated by the Seller or where otherwise required by law.
The Consumer will receive a refund of the amounts paid for the returned Products and, where required by law, the standard delivery costs originally incurred. Any additional costs resulting from the Customer's choice of a delivery method other than the least expensive standard delivery option shall not be refunded.
The Consumer's rights under the applicable legal guarantee of conformity remain unaffected.
11. COMMERCIAL RETURNS AND EXCHANGES
In addition to the statutory right of withdrawal, the Seller offers a commercial return policy within 14 days from delivery of the Product, subject to the conditions set out in this section.
The commercial return policy is an additional option offered by the Seller and does not limit the statutory right of withdrawal or any rights granted to Consumers under the legal guarantee of conformity.
Direct return costs relating to a commercial return shall be borne by the Customer, unless otherwise stated by the Seller.
To be accepted, the Product must:
-
not have been worn or used;
-
not have been washed;
-
be intact and free from signs of use or wear;
-
be free from stains, odors, damage or alterations;
-
be complete with its original tags, labels and accessories, where applicable;
-
be returned in a condition suitable for resale.
All commercial returns are subject to a quality control inspection. If the returned Product does not meet the above conditions, the commercial return may be rejected and no refund will be issued.
In such case, the Product will be shipped back to the Customer at the return address provided. Any reshipping costs shall be borne by the Customer.
Commercial Exchange
The Seller also offers the possibility of a free commercial exchange within 14 days from delivery of the Product, subject to availability.
An exchange may be requested for:
-
a different size of the same Product;
-
a different color of the same Product;
-
a different Product.
The commercial exchange is free of charge for the Customer: the costs of collecting the Product to be exchanged and shipping the new Product shall be fully borne by the Seller.
Products returned as part of a commercial exchange are also subject to quality control and must meet the conditions applicable to commercial returns.
If the new Product has a higher price than the Product originally purchased, the Customer must pay the price difference using the payment method indicated by the Seller. The new Product will be shipped once payment of the difference has been received.
If the new Product has a lower price than the Product originally purchased, the price difference may, at the Customer's choice, be provided as credit to be used on the Site or refunded using the same payment method used for the original purchase.
If the Customer chooses store credit, it may be used in accordance with the terms communicated by the Seller.
Exchanges are subject to availability of the requested Product. If the selected Product is unavailable, the Customer may choose another available Product or request a refund in accordance with the applicable terms.
The procedures for requesting a return or exchange are indicated on the Site.
The commercial return and exchange policy does not limit the statutory right of withdrawal or the Consumer's rights relating to the legal guarantee of conformity.
12. REFUNDS
In the event of a valid exercise of the right of withdrawal, the Seller shall refund all payments received from the Consumer, including, where required by law, the standard delivery costs originally incurred.
The Seller is not required to refund any additional costs resulting from the Customer's choice of a delivery method other than the least expensive standard delivery option.
Costs incurred by the Consumer for returning the Products shall not be refunded and shall remain borne by the Consumer, except where otherwise required by law.
The refund shall be made without undue delay and, in any event, within 14 days from the date on which the Seller was informed of the Consumer's decision to withdraw.
However, the Seller may withhold the refund until the returned Products have been received or until the Consumer has provided evidence that the Products have been returned, whichever occurs first.
The refund shall be made using the same payment method used by the Consumer for the original transaction, unless otherwise agreed with the Consumer and without any additional fees for the Consumer.
Refunds relating to commercial returns shall be handled in accordance with the applicable commercial policy.
13. PRODUCTS EXCLUDED FROM THE RIGHT OF WITHDRAWAL
The right of withdrawal is excluded in the cases provided for by applicable law.
By way of example, where applicable, the right of withdrawal does not apply to goods made to the Consumer's specifications or clearly personalized, or to sealed goods which are not suitable for return for reasons of hygiene or health protection and which have been unsealed after delivery.
Any further exclusions provided for by law shall apply within the limits and under the conditions established by applicable legislation.
14. LEGAL GUARANTEE OF CONFORMITY
Products purchased by Consumers are covered by the legal guarantee of conformity provided for by applicable law.
The Seller is liable for lack of conformity existing at the time of delivery of the Product and becoming apparent within the period prescribed by law, currently two years from delivery for new goods.
In the event of a lack of conformity, the Consumer is entitled, free of charge, to the remedies provided by law, including, where applicable, repair or replacement of the Product. In the cases and under the conditions provided by law, the Consumer may also be entitled to a price reduction or termination of the contract.
Repairs or replacements carried out under the legal guarantee of conformity shall not involve any costs for the Consumer, including, where required by law, the costs necessary for returning and redelivering the Product.
The legal guarantee does not cover damage or defects resulting from improper use, use contrary to the instructions, normal wear and tear or events occurring after delivery that are not attributable to the Seller, to the extent permitted by law.
To exercise their rights in relation to a lack of conformity, the Customer must contact Customer Service using the methods indicated on the Site and, where possible, provide the order number and a description of the issue.
15. COMPLAINTS AND CUSTOMER SERVICE
For requests relating to orders, Products, shipments, returns, exchanges or the legal guarantee, the Customer may contact Customer Service using the contact details and procedures indicated on the Site.
For faster handling of the request, the Customer is encouraged to provide the order number and all relevant information and supporting documentation.
The Seller undertakes to handle complaints and customer service requests within a reasonable period and in compliance with applicable law.
For disputes concerning relationships with Consumers, the alternative dispute resolution (ADR) mechanisms provided for by applicable law remain available, where applicable.
16. FORCE MAJEURE
The Seller shall not be liable for delays or failure to perform its obligations where such events are caused by circumstances beyond its reasonable control, including, by way of example, natural disasters, exceptional weather events, war, civil unrest, strikes, epidemics or public health emergencies, interruptions to essential services, telecommunications, transport or services provided by third parties.
The Seller shall take all reasonably possible measures to mitigate the effects of such circumstances and shall inform the Customer where these circumstances significantly affect the performance of the order.
This clause does not limit any mandatory rights granted to Consumers by law.
17. PRIVACY
The Customer's personal data is processed in compliance with applicable data protection legislation and in accordance with the Site's Privacy Policy.
Customers are encouraged to review the Privacy Policy before making a purchase.
18. AMENDMENTS TO THE TERMS AND CONDITIONS
The Seller may amend or update these Terms and Conditions at any time.
The version applicable to each purchase shall be the version published on the Site at the time the relevant contract is concluded.
Subsequent amendments shall not affect contracts already concluded or rights already acquired by the Customer.
19. THIRD-PARTY SITES, SERVICES AND PROVIDERS
The Site may use or link to services, tools and websites operated by third parties, including, by way of example, payment service providers, shipping providers, analytics, technology and customer support providers.
The use of third-party services may be subject to their respective terms and conditions and privacy policies.
The Seller shall not be responsible for the content, functionality or policies of third-party websites and services that are not under its direct control, without prejudice to applicable law.
20. LIABILITY
The Seller does not exclude or limit its liability where such exclusion or limitation is not permitted by law.
The Seller shall not be liable for damages arising from circumstances beyond its reasonable control or from use of the Products that is inconsistent with their characteristics, instructions or intended purpose, to the extent permitted by applicable law.
Nothing in these Terms and Conditions shall limit or exclude any mandatory rights granted to Consumers by law, including rights relating to the right of withdrawal and the legal guarantee of conformity.
21. SEVERABILITY
If one or more provisions of these Terms and Conditions are found to be invalid, ineffective or unenforceable, the remaining provisions shall remain in full force and effect to the extent permitted by law.
The provision concerned shall be interpreted or, where necessary, replaced to the extent necessary to make it compliant with applicable law, without prejudice to the Consumer's mandatory rights.
22. GOVERNING LAW AND JURISDICTION
These Terms and Conditions are governed by Italian law, without prejudice to any mandatory provisions protecting Consumers under applicable law.
For disputes involving Consumers, jurisdiction shall lie with the court determined in accordance with the mandatory rules applicable to consumer protection.
For customers purchasing for professional or commercial purposes, unless otherwise provided by any mandatory applicable law, the Court of Chieti, Italy, shall have exclusive jurisdiction over any dispute relating to these Terms and Conditions or the relevant sales contracts.
23. FINAL PROVISIONS
These Terms and Conditions, together with the information provided to the Customer during the purchasing process and any policies published on the Site, govern purchases made through visionofsuper.com.
In the event of any conflict between a provision of these Terms and Conditions and a mandatory provision of applicable law, the latter shall prevail.
For matters not expressly governed by these Terms and Conditions, the applicable Italian and European laws and regulations shall apply.
