TERMS AND CONDITIONS OF SALE

1. DEFINITIONS
For the full understanding and acceptance of these General Terms and Conditions, the following terms, both singular and plural, shall have the meanings set out below:

• Aeffe Lab s.r.l.: the company that owns the website, with registered office at Via Capestrano, 10 - 66100 Chieti, Italy (VAT No. 02479750693);
• visionofsuper.com: the website managed by Aeffe Lab s.r.l., an e-commerce platform for the purchase of clothing and accessories produced internally or by third parties;
• Products: the products and/or services offered through visionofsuper.com;
• User: any person accessing visionofsuper.com, regardless of their legal status or purpose, interested in the Products offered through visionofsuper.com;
• Consumer: a natural person acting for purposes unrelated to any commercial, business, craft, or professional activity carried out;
• Conditions: this agreement governing the relationship between Aeffe Lab s.r.l. and the Users and the sale or supply of the Products offered through visionofsuper.com.

2. EXECUTION, CONCLUSION AND EFFECTIVENESS OF THE CONDITIONS
The purchase agreement for the Products is concluded through the correct completion and submission of the order form. The form contains the details of the purchaser and the order, the price of the purchased Product, any additional charges, payment methods and timing, delivery address, delivery times, information regarding the right of withdrawal, and consent to the processing of personal data.
When Aeffe Lab s.r.l. receives the order from the User, it sends a confirmation email or displays a printable web page confirming the order and summarizing its details.
The Conditions shall not be considered effective between the parties in the absence of the provisions stated above.
Aeffe Lab s.r.l. may modify or simply update these Conditions, in whole or in part. The User acknowledges and accepts that any changes to these Conditions shall apply to orders submitted after the date on which the changes are communicated. Users are therefore invited to review the Conditions each time they access visionofsuper.com and are advised to print a copy for future reference.

3. REGISTRATION
In order to use certain features of visionofsuper.com, Users must register by providing truthful and complete information in the registration form and fully accepting the Privacy Policy and these Conditions.
Users are responsible for keeping their login credentials confidential.
Under no circumstances shall Aeffe Lab s.r.l. be held liable for loss, disclosure, theft, or unauthorized use of Users’ login credentials by third parties for any reason.

4. ACCOUNT CANCELLATION AND CLOSURE
Registered Users may deactivate their account or request its deletion via the visionofsuper.com interface, if available, or by sending a written request to Customer Service.
Aeffe Lab s.r.l., in the event of violation by the User of these Conditions or applicable laws, reserves the right to suspend or terminate the User's account at any time without prior notice.

5. PURCHASES ON VISIONOFSUPER.COM
The purchase of one or more Products through visionofsuper.com is permitted both to Users who qualify as Consumers and to those who do not.
Pursuant to Article 3, paragraph 1, letter a) of Legislative Decree 206/2005 (“Consumer Code”), Consumers are defined as natural persons who act for purposes unrelated to entrepreneurial, commercial, professional, or craft activities.
Only individuals who are at least eighteen (18) years old are authorized to make purchases.
Aeffe Lab s.r.l. undertakes to describe and present the Products sold on visionofsuper.com as accurately as possible. However, some errors, inaccuracies, or small differences between the website and the actual product received may occur.
Furthermore, product photographs on visionofsuper.com are purely illustrative and do not constitute a contractual element.
The User expressly grants Aeffe Lab s.r.l. the right to partially accept the order placed (for example, if not all ordered Products are available). In such case, the contract shall be deemed concluded only with regard to the Products actually sold.
Aeffe Lab s.r.l. reserves the right to refuse or cancel an order in the following cases:

• When the Product is not available;
• When the authorization request for charging the User for the Product price is denied;
• When an obviously incorrect and recognizable price is indicated at the time of purchase.

In such cases, the User will be contacted by Customer Service and will receive a refund for the transaction made.

6. PRICES AND PAYMENTS
Aeffe Lab s.r.l. reserves the right to change the price of the Products and any shipping costs at any time. Such changes will not affect contracts already concluded before the modification.
The sale prices of the Products include VAT where applicable. Any other taxes and/or shipping costs will be indicated before confirming the purchase.
The User undertakes to pay the price of the purchased Product according to the methods and timeframes indicated on visionofsuper.com.
Any refunds to the User will be credited promptly after careful verification and inspection of the returned product using one of the methods proposed by Aeffe Lab s.r.l. and chosen by the User and, in the case of exercising the right of withdrawal, no later than 14 days from the date on which Aeffe Lab s.r.l. became aware of the withdrawal, subject to delays in the return of the product.
visionofsuper.com uses third-party payment tools to process payments and does not in any way come into contact with the payment data provided (credit card number, cardholder name, passwords, etc.).
If such third-party tools deny payment authorization, Aeffe Lab s.r.l. will not be able to provide the Products and shall not be responsible for any delays or failure to deliver.

PAYMENT METHODS

PAYPAL
Customers may pay the purchase price through PayPal using their PayPal account according to the PayPal terms and conditions accepted by the customer.

CREDIT CARD / PREPAID CARD
When paying by credit card, the card details transmitted during the order process are protected and sent directly to the banking institution that manages the payment.
Payment takes place on a secure server with SSL encryption. Credit card data are not accessible to the Seller or third parties either during the order process or afterwards.
All card data are transmitted to the secure online banking system provided by Stripe Payment. Payments through Visa, MasterCard, American Express, Apple Pay and related circuits are accepted.

INSTALLMENT PAYMENT
When paying through Klarna, the customer receives the order immediately and pays in installments. The customer acknowledges that the installments will be assigned to Klarna, its affiliates, and their assignees, and authorizes such assignment.

7. INVOICING
Users wishing to receive an invoice must enter their billing information during the purchase and subsequently request the invoice by sending an email to Customer Service.
For the purposes of issuing the invoice, the data provided by the User shall prevail. The User declares and guarantees that such information is accurate, releasing Aeffe Lab s.r.l. from any related liability.

8. DELIVERY OF PHYSICAL PRODUCTS
A “Physical Product” means any movable good or digital good supplied on a tangible medium offered through visionofsuper.com.
Ordered Physical Products will be delivered to the User at the address provided during the purchase using the method selected by the User or indicated on visionofsuper.com.
Delivery will take place within the timeframes indicated in the order confirmation.
Upon receipt, the User must verify that the package and the delivered product correspond to the order placed. In case of visible damage or discrepancies, the User must promptly report the issue.
If an order exceeds stock availability, Aeffe Lab s.r.l. will inform the User by email and confirm whether the Product is no longer available or indicate the expected waiting time.
Aeffe Lab s.r.l. is not responsible for delays or failure to deliver Products due to force majeure events such as accidents, strikes, natural disasters, etc.

9. PRODUCT INFORMATION
All Products presented on visionofsuper.com are accompanied by a detailed description which may include images, technical specifications, and any other useful information for purchase.
Aeffe Lab s.r.l. is not responsible for any errors or inaccuracies in such information.

10. USER RESPONSIBILITY
The User assumes full responsibility for the use of the purchased Products and agrees to use them in compliance with applicable laws and the instructions provided with the Product.

11. RIGHT OF WITHDRAWAL
As a Consumer, the User has the right to withdraw from the contract within 14 days from the delivery of the Products without providing any reason.
The withdrawal period expires 14 days after the day on which the User, or a third party designated by the User, acquires physical possession of the Products.
Return shipping costs are borne by the customer.
To exercise the right of withdrawal, the User must send an explicit communication to Aeffe Lab s.r.l. using the appropriate form.

12. PRODUCTS NOT SUBJECT TO WITHDRAWAL
The right of withdrawal does not apply to the supply of sealed goods that are not suitable for return for health protection or hygiene reasons and that have been unsealed after delivery.

13. FORCE MAJEURE
Aeffe Lab s.r.l. shall not be liable for delays or failure to perform obligations due to force majeure events including, but not limited to, wars, strikes, illness, health emergencies, energy supply interruptions, or transport delays.

14. PRODUCT WARRANTY
Products are covered by a warranty against manufacturing defects and lack of conformity for two years from delivery.
In the event of non-conformity, the User has the right to replacement of the Product without additional costs.

15. COMPLAINTS AND REQUESTS
For any issue or request related to purchased Products, the User may contact Customer Service, which will respond within a reasonable timeframe.

16. PERSONAL DATA PROTECTION
Users’ personal data are processed by Aeffe Lab s.r.l. in accordance with applicable privacy regulations and the policies indicated in the Privacy Policy available on visionofsuper.com.

17. CONTRACT MODIFICATIONS
Aeffe Lab s.r.l. reserves the right to modify these Conditions of Sale at any time. Any changes will not affect orders already confirmed.

18. GOVERNING LAW AND JURISDICTION
These Conditions are governed by Italian law.
Any dispute arising from the interpretation, execution, or validity of the contract shall fall under the exclusive jurisdiction of the Court of Chieti (Italy).

19. LIMITATION OF LIABILITY
Aeffe Lab s.r.l. shall not be liable for damages resulting from circumstances beyond its control, including internet failures, third-party fraud, or improper use by the User.

20. PARTIAL VALIDITY
If one or more provisions of these Conditions are declared invalid or ineffective, the validity of the remaining provisions shall not be affected.

21. LINKS TO THIRD-PARTY WEBSITES
visionofsuper.com may contain links to third-party websites. Aeffe Lab s.r.l. is not responsible for the content of such websites.

22. COMMUNICATIONS
Official communications must be sent in writing to the Customer Service of Aeffe Lab s.r.l. or via email to the contact address indicated on visionofsuper.com.

23. INVALIDITY OF INDIVIDUAL CLAUSES
If any provision is deemed invalid, the remaining Conditions shall remain effective.

24. PRIVACY
The protection of personal data is governed by the Privacy Policy available on the website.

25. ONLINE DISPUTE RESOLUTION FOR CONSUMERS
Consumers residing in Europe may use the EU Online Dispute Resolution platform:

26. PRICES AND CURRENCY
Prices are expressed in Euro (EUR), unless the User is located in the United Kingdom or the United States, where prices will be displayed in Pounds Sterling (GBP) or US Dollars (USD) respectively.
Payments are processed in Euro and exchange rates may vary.

27. FINAL PROVISIONS
These Conditions fully govern the relationship between Aeffe Lab s.r.l. and the User and prevail over any previous agreements.
